YESTERDAY'S VOTE BY ALEXANDRIA CITY COUNCIL ON JERRY JONES: WILL AN ETHICS COMPLAINT FOLLOW?

At yesterday's Alexandria, Louisiana City Council meeting, Alexandria City Attorney Chuck Johnson placed upon the Finance and Legal Affairs committee for it consider a resolution ratifying and acknowledging all official acts of newly appointed District 3 Councilman Jerry Jones since his date of appointment on December 13, 2011.

That committee voted two to three, Councilmen Jim Villard and Chuck Fowler voting yes and Councilman Roosevelt Johnson voting no, to send the resolution to the full City Council. Believe it or not, the three pro-Alexandria Mayor Jacques Maurice Roy White councilmen voted for the resolution and Uncle Tom Councilman Jerry Jones voted for his own resolution.

Attorney Chuck Johnson told the Council that the ratifying of Jones acts wasn't really necessary but that he was proposing it out of an abundance of caution. But Council woman Mitzi Gibson proposed that the Council first seek an Attorney General's opinion of whether Councilman Jones actually took office when he was hand-picked by Mayor Roy on December 13, 2011 by his breaking the tie between the three White Councilmen and the three Black Council persons, or he became official on December 16, 2011 according to what had been told to Mrs. Gibson by an attorney with the Louisiana Secretary of State's office. That attorney told her that she should request an Attorney General's opinion.

The Council, however, decided to pass the resolution without requesting an Attorney General's opinion in a 4 to 3 vote, with the lap dogs voting for it and the three remaining Council members voting against it.

Without getting into the legality of when Councilman Jones' service upon the Council actually occurred, in my learned opinion, Mr, Jones violated Louisiana's ethics laws. Specifically, I believe that Jones violated LSA-R.S. 42:1116 which basically prohibits public employees and elected officials from using their position to their economic or political advantage.  This vote could also have the effect of Mr. Jones getting paid for that December 13th meeting.

You will also recall that Mayor Roy was eager to have Mr. Jones seated upon the City Council on December 13th so that he could vote on Councilman Harry Silver's presidency, which he had the deciding vote, and on the mayor's Alexander Fulton Hotel plans. But the question arises on whether Silver could vote on Jones' appointment on December 13th or on his ratification yesterday due to it being rumored that Mr. Jones did business with Mr. Silver's haberdashery business and even had a charge account there.

Councilman Ed Larvadain, III asked whether Jones could even vote on his own resolution and Councilman Chuck Fowler said "certainly". Councilman Fowler should know because he himself faced ethics charges for his dealing with Cleco while serving upon the City Council. (See: "Chuck Fowler Ethics Opinion").

  1. Greg, you failed to mention that the Mayor was not in attendance at the committee meeting. But Kay, Trey, and Chuck Johnson were being called outside and returning with documents and a closing reading. So why wasn't he down there being a part of the process?


    Also,Mr. Jones made a statement about how much of a waste of time it was to discuss the matter of the resolution and his appointment. I guess he does not realize that it is the right of the citizens to voice their ideas and concerns no matter what the item is on the agenda. What he votes on does affect the whole city no matter what it is. The law and what was done legally or illegally was the item to be disussed not drainage, or some other subject. I think he needs to ask himself why all of a sudden is the Mayor putting him in the spotlight and making him the man of the hour.

    If you will recall Chuck Fowler wanted to hurry the process of the budget along without any discussion of the items. Thanks to Ms. Gibson and Mr.Larvadain the discussion continued on. ON the agenda of legal fee, there was a revision of the professional fees on Jan. 24,2012. Instead of 93,000 it was increased to 393,000.

  2. For those have seen the Jan 24,2012 COA Council meeting, why did the old FART SILVER had to have the
    Council Clerks read for him and repeat the motion &
    seconds from the Council! DAMN three people during the job of the President! SILVER needs to set down as President and save the COA from any future embrassement because he truely looks sad as a LEADER
    but DUMBASS ROY NEEDS A PUPPET, so saddddd!!! LOL
