THE CITY OF ALEXANDRIA DENIES YOUR CONSTITUTIONAL RIGHTS

This morning on the Eyes Open talk radio show with host Tony Brown, there was a discussion about the City of Alexandria's denial of your Constitutional rights.

Those that you will hear on this sound clip, besides Tony, are Mr. Jules Green, Rev. Ameal Jones, Sr., pastor of the Alexandria, Louisiana, Mt. Zion Missionary Baptist Church and is the president of the local NAACP chapter. and Alexandria City Councilman Ed Larvadain, III.


Even though the co-host of KSYL radio's Talk Back Pre-Show, Fred Rosenfeld, expressed disbelief at a caller's assertions that the City of Alexandria was putting in its contracts for the lease of its facilities that the lesse couldn't say anything negative about the City ("MORE ON THE MLK, JR. DAY VOTER REGISTRATION DRIVE"), that is exactly what the City of Alexandria is doing.

As the caller told Fred, the City's contract (No. 11) for the lease of the City's buildings and facilities provides in pertinent part that the City may terminate the lease if the lessee "... shall operate to the discredit of the City of Alexandria...".



A principle of Constitutional law is that no law may be enacted which is vague or ambiguous. What exactly does "discredit" mean and who decides that?

The U.S. Constitution - Amendment 1 provides: "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances". This was made applicable to the states and their local governments by the 14th Amendment. These pronouncements are even stronger under the Louisiana Constitution of 1974.

Of course this isn't the first time that Alexandria Mayor Jacques Roy has curtailed citizens from speaking out against the city as was the case with the Alexandria City Police Department (A.P.D.) and the Alexandria Housing Authority (A.H.A.). It would seem that with the virtual plethora a\of lawyer we have at and with City Hall, one of them might have noticed this.

The City of Alexandria requires an I.R.S. 501(c)(3) tax exemption for the waiver of a fee for the use of City buildings. But that doesn't explain why the sorority was allowed to register voters at all previous King celebrations free from any fees. Besides that, Alpha Kappa Alpha does have a 501(c)(3) tax exemption. The sponsor of King Day and the Buffalo Soldiers did have their fees waived by the City. Why not Alpha Kappa Alpha as well?

  1. I understand that the members of Alpha Kappa Alpha and their attorneys will be at the council meeting Tuesday. Want to bet what will happen? Will Roy show up... I would be surprised if he did. 2. He will blame Chuck Johnson .3. He will put the buck on Larry Love. 4.Miscommunication between the parties. 5. He want take the blame.
