Some of you seem to still have confusion about E.M.S. and Jacques Roy. Let me explain it to you once again and as simply as I can.
David Pugh and Sam Sansing were former employees of Cleco.
David Pugh formed E.M.S. and it hired Sam Sansing.
E.M.S. went to the City of Alexandria and told it that Cleco was defrauding it.
E.M.S. signed a 50% fee contract with the City whereby E.M.S.would get that percentage of any money that the City recovered for the City.
E.M.S. began obtaining the Cleco documents that helped the City prove fraud on the part of Cleco.
Cleco sued Pugh and Sansing. The law firm of Johnson and Siebeneicher represented David Pugh and E.M.S. and still represents them to this day. Chris and Jacques Roy represented Sam Sansing.
Jacques Roy, without the presence of Johnson and Siebeneicher, renegotiated the E.M.S. contract between E.M.S. and the City of Alexandria down to 20%.
Jacques Roy is then elected mayor of Alexandria. He fails to disclose, what is in my opinion, his legal representation of E.M.S. to the City Council.
Several months after Jacques Roy became mayor, he withdrew as the attorney for Sam Sansing.
After the settlement with Cleco, Jacques refused to pay E.M.S. anything.
E.M.S. then sued the City of Alexandria with Johnson and Siebeneicher still as its attorney. In my opinion, and others, it was at the point in time that Jacques refused to pay E.M.S. that his conflict of interest arose with E.M.S.
After several days of mediation, the City and E.M.S. agreed to a settlement of $3.75 million. The payment of that amount out of the $3 million paid by Cleco for legal and expert fees was halted by the attorneys that are currently suing the City of Alexandria for their legal fees.
So from the above facts, I don't see how Jacques Roy was acting on behalf of E.M.S. when settling Cleco. David Pugh and Sam Sansing told the Town Talk that they felt as if the City shouldn't settle with Cleco and have its day in court.
