MORE IGNORANT RANT FROM KSYL'S DAVE GRAICHEN

Dave Graichen, a radio "personality", whatever that is supposed to mean, on KSYL's "Talk Back" radio came up with more nonsensical lawyer bashing once again today. It sounds like ole Dave may have run over somebody or not paid his bills and was sued by a lawyer, based upon his intense hatred for lawyers. And, as usual, Dave misstated the facts to support his lawyer bashing.

Listen to this sound clip, wherein Dave states that the reason we have so much testing of drugs by the FDA is because of American "ambulance chasing lawyers" bringing class action lawsuits against drug companies.

First, unlike Dave says, class action lawsuits filed against drug manufacturers are not just an American thing. See for example the class action suit filed against "Eli Lilly on behalf of Canadians who took the anti-psychotic drug Zyprexa and were subsequently diagnosed with diabetes." Dave's saying that lawsuits against drug manufacturers are caused by trial lawyers 'puts the cart before the horse'. The first thing that needs to happen is that there has to be some medical or scientific proof that a drug causes harm. Only then can a lawyer know what to file a lawsuit for. Next, the lawyer has to prove the case to a judge or a jury. There are also tremendous immunities from suit in place to protect drug companies. Then, the judgment, if there is one, has to survive years of appeals.

I don't know what Dave has against people suing drug companies for intentionally or negligently causing death and illness from the manufacture of their products. Who best to pay the resulting medical bills, the manufacturer or the government?

I also wonder what makes a radio record player know so much about the law, the manufacturer of drugs or class action lawsuits? Does Dave even care about the truth?
